These Terms & Conditions ("Terms") govern your use of the "Discover Crediton" website (the "Website") and any related services provided through it (collectively, the "Services"). By accessing or using the Website and Services, you agree to be bound by these Terms. If you do not agree, you must not use the Website or Services.

If you are using the Website or Services on behalf of a business or other legal entity, you confirm that you have authority to bind that entity to these Terms.

1. Intellectual Property

The content displayed on the Website — including text, graphics, images, photographs, videos, articles, and other materials — is protected by copyright, trademark, and other intellectual property laws.

  • All rights in such content are owned by Discover Crediton, its licensors, or the respective individuals, businesses, or amenities who have granted Discover Crediton permission to use their works.
  • Contributors (e.g. local businesses and amenities) retain ownership of their own content. By submitting content, you grant Discover Crediton a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content for the purposes of operating and promoting the Website.
  • You may not copy, distribute, modify, or create derivative works of Website content without express permission, except as permitted by law.

2. User Content and Conduct

You may be able to post reviews, comments, photographs, or other content ("User Content"). You agree that User Content must not be:

  • illegal, obscene, defamatory, threatening, harassing, or otherwise unlawful;
  • infringing on any intellectual property rights or privacy rights;
  • harmful, misleading, or offensive.

Discover Crediton reserves the right (but not the obligation) to monitor, edit, or remove User Content at its discretion. You are solely responsible for your User Content, and you warrant that you have all necessary rights to post it.

By submitting User Content, you agree to indemnify and hold Discover Crediton harmless from any claims or damages arising from your breach of this section.

3. Prohibited Uses

You agree not to use the Website or Services for any purpose that is unlawful or prohibited by these Terms, including (without limitation):

  • attempting to gain unauthorised access to the Website, its servers, or related systems;
  • interfering with or disrupting the security, integrity, or performance of the Website;
  • using automated tools (such as bots or scrapers) without our prior written consent.

4. Service Availability and Termination

We aim to keep the Website available, but we do not guarantee uninterrupted access and may suspend, withdraw, or restrict the availability of all or part of the Website at any time.

We reserve the right to suspend or terminate your access to the Website if you breach these Terms.

5. Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

  • fraud or fraudulent misrepresentation;

Subject to the above, Discover Crediton shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of the Website or Services.

6. Consumer Protection

If you are a consumer, you have certain statutory rights under UK law (including the Consumer Rights Act 2015). Nothing in these Terms is intended to restrict those rights.

If the Services are provided free of charge, certain consumer rights (such as cancellation rights under the Consumer Contracts Regulations 2013) may not apply. Where paid services are offered in the future, additional terms will be provided.

7. Defamation and Illegal Content

Users must not post, upload, or otherwise transmit content that is defamatory, abusive, discriminatory, or otherwise unlawful.

Discover Crediton does not endorse or assume responsibility for User Content but may remove or disable access to content that breaches these Terms or applicable law.

If you believe content hosted on the Website is defamatory or unlawful, please contact us immediately at admin@crediton.uk. We will review and take appropriate action as required by law.

8. Changes to Terms

We may update these Terms from time to time. Any changes will take effect upon posting the updated version on the Website. The Effective Date at the top will be updated accordingly.

9. Governing Law and Jurisdiction

These Terms, and any disputes arising out of or relating to them, are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction, except that if you are a consumer resident in Northern Ireland or Scotland, you may also bring proceedings in your local courts.
